These Terms of Service ("Terms") govern your access to and use of Bearing, the profit analytics platform operated by Bearing ("we", "us", or "our"), available at trybearing.app. By creating an account or using the service, you agree to these Terms.
To use Bearing you must register for an account, provide accurate information, and keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old and authorized to bind any business entity you sign up on behalf of.
Bearing provides analytics, forecasting, and reporting features for e-commerce stores. We connect to your Shopify store, advertising platforms, and other services you authorize to display performance data and projections. The service is provided on a subscription or evaluation basis as offered at the time of signup.
You retain all rights to data you upload or that we access on your behalf through authorized integrations ("Customer Data"). You grant us a limited license to process Customer Data solely to operate the service for you. Our handling of Customer Data is governed by our Privacy Policy.
Bearing integrates with third-party services including Shopify, Google Ads, Meta, TikTok, Pinterest, Snapchat, X, and Klaviyo. Your use of those services remains governed by their respective terms. We are not responsible for changes to those services or for data loss or unavailability caused by them.

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing on 30 days' notice. Failure to pay may result in suspension or termination of your account.
Bearing's forecasts and analytics are statistical estimates based on the data available to us. They are provided for informational purposes only and are not financial, investment, or tax advice. You are solely responsible for business decisions made on the basis of any output from Bearing.
You may cancel your account at any time from within the application. We may suspend or terminate your access if you breach these Terms or if continued provision would expose us to legal or operational risk. On termination, your right to use the service ends; we may delete your data after a reasonable retention period.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that forecasts will match actual outcomes.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the greater of (a) the fees you paid us in the twelve months preceding the claim or (b) one hundred U.S. dollars. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost data, or business interruption.
You agree to indemnify and hold us harmless against any claims, damages, or liabilities arising from your misuse of the service, your violation of these Terms, or your violation of any third-party rights.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions. Any dispute will be resolved in the state or federal courts located in Delaware.
